Before reading all the required Terms and Conditions, which exist so we both have a clear understanding of expectations, we would like you to know something about Mas Nicolas. We use it much of the year so we maintain the high standards you would expect of someone else's home. By renting out the property we are sharing our home with you and will try and ensure you get the same level of pleasure we do each time we stay.
After we have confirmed availability we will 'hold' the property for you for 7 days from the day you confirm your request by email. If your deposit payment does not arrive within the 7 days, we cannot guarantee that your booking will be accepted. When we receive your contract and your deposit payment, we will acknowledge receipt by email. At this moment a binding contract between you and us comes into existence.
PRICES and DEPOSIT
All prices are quoted in £ per week. We will also ask for the breakages/cleaning deposit. The method of payment is cheque or credit or debit card. The breakage / cleaning deposit will be returned to you within 21 days of your departure less, if applicable, extra damage or/ and exceptional cleaning costs.
TELEPHONE
Local: There is telephone for local calls provided. Under 30 minutes week of local calls will not be charged.
International: If you make international calls on the house phone you will be charged at the rate of £0.10 per minute for every call and there is no free period. Money will be deducted from your deposit.
For your convenience we suggest you also bring your mobile telephone.
PAYMENTS
Any request for a reservation must be accompanied by a signed Booking Form and a 50% deposit.
The remaining 50% is due 8 weeks before the start of your holiday.
In the event of non-payment on time, your rental agreement could be cancelled without notice, with no refund of the renting deposit
For bookings made less than 56 days (8 weeks) before the arrival date at the holiday property, the whole rent must be paid at the time of booking.
We can also accept the deposit payment by credit or debit card in GB pounds sterling, however this method carries a service charge of 2.0%. Please let us know if you would prefer this method and we will arrange a convenient time to obtain your card details if you have not already provided them on this form ( optional). When we take a payment by credit card you will get secured receipt.
CANCELLATION BY YOU
In the event of cancellation by you more than 24 weeks before the booking date 50% of the renting deposit is refundable. Less than 24 weeks before the booking date the deposit (50% of the total renting value) will not be refundable. Any breakage / cleaning deposit if paid is immediately refundable.
It is therefore essential that you take out adequate holiday insurance, so that should you have to cancel due to ill health or for another reason beyond your control, (e.g. jury service obligation), your deposit can be reimbursed by your insurance company.
In the event of a cancellation being made after the full amount has been paid, we will refund you in accordance with this schedule. Number of full weeks before start of holiday that written notice of cancellation is received by us. Amount forfeited as % of total rent Before 24 weeks the 50% deposit 6 to 8 weeks 50% deposit + 20% = 70% 4 to 6 weeks 50% deposit + 40% = 90% less than 4 weeks 100 %
Please inform us immediately by telephone and confirm your cancellation in writing by email.
ALTERATIONS BY YOU
If after we have issued a Booking Confirmation, you wish to alter your booking, please let us know immediately. We will endeavour to accommodate you but this is not a guarantee you will be able to change your dates and any change will only be possible within the same calender year.
CANCELLATION BY US
In the unlikely event that we have to cancel your booking or there are major changes to it due to matters beyond our control which are not covered under 'Force Majeure' (see below), we will advise you as soon as possible and will endeavour to offer you suitable alternative accommodation.
If this is not possible, or you do not wish to accept the alternatives offered, we will give you a complete refund of all monies paid by you.
ARRIVAL & DEPARTURE
Change-over days are on Saturday unless otherwise stated or agreed. The property will be available to you no later than 4.30 pm on the day of your arrival and until 10 am on the day of your departure, unless otherwise stated. If you are unable to arrive at 4.30 pm or wish to arrive early and drop-off baggage while you go out until 4.30 pm, please notify us beforehand. If you are delayed en route, you must phone to let us know your expected time of arrival. If you arrive at an unreasonable hour without notification and are unable to gain access to the property, we cannot be held responsible for any cost incurred for alternative overnight accommodation.
PAYMENT OF ANY EXTRA CHARGES & BREAKAGES DEPOSIT
You will need to pay any extra charges for extra cleaning, phone, or breakages.
For the sake of clarity you will find the house totally clean and you are expected to leave the house in the same state as you find it. However we normally make no charges for minor additional cleaning, such as sweeping etc but will not accept dirty bathrooms, toilets or messy unwashed kitchens and appliances. We do normally not accept pets but in the unlikely event that we do, you would be responsible for ensuring that all hair is removed and all mess in the garden, any damage to fabrics and doors will be charged.

YOUR RESPONSIBILITIES: PERSONAL LIABILITY INSURANCE
Should you or other members of your party or guests cause any damage to the property, its contents, grounds, or any third party, then you will be deemed responsible for such damage. In addition to paying a breakages/cleaning deposit, you must also have adequate third-party insurance to cover such an eventuality. Please check that your travel insurance gives you adequate personal public liability cover (i.e. at least €3 million or GB£2 million). You must take a copy of your insurance certificate with you, as we are entitled to see the certificate before allowing you possession of the property. Residents of some countries (e.g. Germany and the Netherlands), may already have third-party liability cover as part of their own home insurance policy. In other countries, such as the UK, this is not usually the case, so UK residents will almost certainly require a comprehensive travel insurance policy.
Only the signatory of the rental agreement needs to be covered for personal liability so long as they accept responsibility for the actions of all other members of the party. (But we still advise all members of the party to in any event have travel insurance to cover them for baggage loss, health & emergency repatriation, cancellation through ill-health or bereavement).
MAKING A FIRE OUTSIDE
This area of France suffers from a big and serious risk of fires. Therefore absolutely no personal outside fires are allowed, It is against French Law to start one and apart from the genuine hazard, which threatens life, you will be sent straight to jail if you are caught making a fire. There is also a potentially unlimited fine for doing this.
Because of the above we suggest that you also avoid making a BBQ. We have provided a small electric BBQ so the fire version is not needed.
CLEANING
The property is cleaned before letting; however you are responsible for keeping and leaving the property, including the grounds in a tidy condition. You are expected to leave the property as you found it..
If the house is left in an unacceptable condition (e.g. dirty kitchen appliances and crockery), we may withhold further monies from your breakages deposit, based on a guide figure of 14 euro per hour extra cleaning.
SAFETY
You are responsible at all times for the safety and behaviour of your children, especially with regard to swimming pool safety. Even if the pool area has an alarm, accidents can and do happen. There is no substitute for surveying your children!

OCCUPANY & BEHAVIOUR
The occupants for the property is agreed at the time of the booking and must not be exceeded under any circumstances. In the event of failure to comply with this provision, we shall be entitled to ask you to leave the property without refund of monies paid or any other liability to you. This applies to the number of day-time occupants as well as to the number of people sleeping there: While it is of course fine to invite a couple of friends over occasionally, it is not acceptable to have more people coming regularly to use the property. We are also entitled to ask you to leave the property without any refund if, in our reasonable opinion, your behaviour is unacceptable (e.g. drunken or loutish behaviour).
PETS
No pets or other animals are normally allowed unless we give you permission in writing.
SMOKING
No smoking is allowed anywhere at anytime in the property (even if the windows are open). As the owners and the majority of the people who stay in the property do not like the smell of smoke we strongly advise you not to break this rule, if the property is found to smell of smoke we will certainly charge you for additional cleaning.
COMPLAINTS
On arrival please check that the property conforms to the description. Should you find any discrepancy or that any of the amenities listed in the property description are damaged or broken, or if you have any other cause for concern (e.g. issues of safety) please bring it to our attention immediately so we can resolve the problem, but also so that you are not blamed for any damage that may have been caused by previous tenants. If you are unable to contact us or our representatives, please contact our emergency number.
No complaint will be entertained unless it is raised with us or our representative personally before the property is vacated and confirmed in writing before the end of your holiday.
LIMITATION OF OUR LIABILITY
We cannot be held responsible for disruption of local services beyond our control, for example water supply, electricity and telephone, nor for temporary noise nuisance such as road works. These problems affect all residents, irrespective of whether they are holiday-makers or not. FORCE MAJEURE: We cannot accept liability in any circumstances where performance of the contract is prevented by reason of: War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action or any similar events outside our control.
We do of course have house insurance, but under French Law the tenant shares a measure of responsibility for the property and its contents during the rental period. You must ensure that your personal insurance offers a high degree of personal liability (typically up to €3,000,000 or equivalent). Please check all details of your Booking Form and Booking Confirmation carefully.
A submitted booking form is taken as proof that you have read, understood and agreedwith the above Terms and Conditions, and those that apply to the property you are renting, and that you will abide by them.
Under no circumstances shall our liability to the tenant exceed the amount paid to us for the rental period. European Law shall govern this contract in all its aspects. .
